Kansas Surface Owners Notice Act - New Requirements for Operators
In 2009, the Kansas Legislature passed Senate Sub. for House Bill 2032, the Kansas Surface Owner Notification Act (KSONA). As of July 1, 2010, when submitting the:
- Notice of Intent to Drill (C-1 form);
- Cathodic Protection Borehole Intent to Drill (CB-1 form);
- Request for Change of Operator/Transfer of Injection or Surface Pit Permit (T-1 form); or
- Well Plugging Application (CP-1 form);
operators are required to attach the KSONA-1 form certifying compliance with this act. When filing a C-1 or CB-1, operators are also required to include preliminary, nonbinding estimates of the locations of tank batteries, lease roads, pipelines and electrical lines. Operators may elect to have the KCC send this information to the surface owner, but a $30.00 fee (per application) will be assessed to offset the cost the KCC will incur by processing and sending the information. Any of the above-referenced forms, which fail to meet all of the requirements of KSONA, will be returned to the operator for resubmission, without the requested authorization being granted.
